Supreme Court denies RAILA’s application for a Forensic Audit of IEBC's ICT system


Tuesday, the 26th of March 2013 -The Supreme Court this afternoon denied an application by Raila Odinga’s lawyer George Oraro to have a forensic carried out on ICT system used by the Independent Electoral and Boundaries Commission (IEBC) in the March 4thelections.

In a ruling read by Justice Mohammed Ibrahim on behalf of the rest of the bench, the Supreme Court said that such a forensic audit would not be possible because the court was pressed for time.

Justice Ibrahim also said that the Supreme Court was of the opinion that it would be possible for the court to determine the merits of the case without having to compel the IEBC to carry out an expensive and time consuming audit.

The Court also faulted CORD for filing its application for a forensic edit late.

The collapse of the IEBC’s ICT system is a major facet of Raila’s case before the IEBC which seeks to prove that Jubilee’s Uhuru Kenyatta did not win the March 4th Presidential election.

The Supreme Court will return with a ruling on Raila’s other application to introduce a 900 page affidavit.
