Ferdinand Waititu Accused of Land Invasion

A former Member of Parliament has been accused of invading a 50-acre parcel of land valued at over Sh1 billion.
The administrator of the estate of Mr Joseph Mwangi Muriithi has urged Lady Justice Pauline Nyamweya to enjoin former Embakasi MP Ferdinand Waititu in the land dispute.

The judge heard that the former lawmaker has already begun work on the disputed land.
Lady Justice Nyamweya directed the case be publicised through an advertisement in one of the main dailies for the public and interested parties to know the existence of a court order stopping any transactions relating to the suit land.
She also ordered that the trial date for the case be advertised. She directed the case be mentioned on May 14.
The administrator of the estate, Mr Benson Ritho Muriithi, told the judge through hislawyers that earthmovers had already been taken to the site and excavation had begun.
In a case he filed under a certificate of urgency, Mr Ritho urges that Mr Waititu be enjoined as an interested party in the dispute.
The judge heard that “Mr Waititu is illegally excavating, digging up and adversely interfering with the suit property despite the existence of a court order issued on March 25, 2013, preventing any development until the matter is heard and determined”.
“We are also seeking that upon being enjoined in the case, an injunction be issued against Mr Waititu, restraining him or his workers from excavating, digging up, transferring or interfering with the suit property until the matter is determined,” pleaded Mr Ritho.
The main dispute arises from a separate ongoing case earlier filed by Mr Ritho, suing in his capacity as the sole surviving administrator of his father’s estate — 50 acres situated off North Road in Embakasi, Nairobi.
Undertake sub-division
Mr Ritho says he was directed by the court to undertake sub-division of the suit premises for distribution to beneficiaries.
He says he commissioned Mr George Ogalo Oner and Geoner Systems Limited to undertake the sub-division. Mr Ritho claims that Mr Ogalo and his associated company fraudulently transferred some of the plots to unknown persons without his consent.- Daily Nation
