LSK unveils team that will audit March 4th elections which UHURU wasdeclared WINNER

Wednesday, the 27th of March 2013 - The Law Society of Kenya (LSK) today named a nine-member team that will conduct a full audit of the March 4th elections.

This happened even as the Supreme Court today began hearing oral arguments in the Presidential election petitions currently before the court.


The IEBC declared Jubilee’s Uhuru Kenyatta the winner of the March 4th Presidential elections with 6,173,433 of the votes cast against CORD’s Raila Odinga who got 5,340,546 votes. It’s the validity of this result that will be probed by the LSK team and is also being contemplated by the Supreme Court.

The LSK team will include Koki Muli, Maina Kiai, Stephen Kiptinness, Alice Kingworm, George Kegoro, Kibe Mungai, Judith Guserwa, Prof Ben Sihanya and Ken Nyaundi.

LSK chairman Eric Mutua said that the probe team will, among other things, investigate the failure of the IEBC’s electronic transfer system;

“We want to determine circumstances that led to the alleged failure of the technology system used for voter identification and transmission of results,” he said

Mutua said that the LSK was conducting the probe because “under Section Four of the LSK Act to protect and assist the public in all matters touching, ancillary or incidental to the law.”

Mutua said that the probe team will also try to determine whether the IEBC acquired its electronic transfer system legally;

“We want to probe whether the Independent Election and Boundaries Commission (IEBC) Voter Identification and Electronic Transmission Systems were properly procured and deployed,” he said.

“We are also interested in determining whether the software supplied for the electronic systems were compatible with IEBCs equipment, had warranties and necessary back up."

The IEBC Chairman said that the probe team has 45 days to produce its report which will include recommendations on how to improve Kenya’s electoral system;

"The report should inform decisions to be taken in order to improve the electoral system and avoid similar occurrences in future as witnessed in the concluded polls,” he said.
