Cord leader Raila Odinga may find himself at the International Criminal Court if the country plunges into violence, Chief Prosecutor Fatou Bensouda as stated.

According to Bensouda, the ICC is closely monitoring the situation in Kenya and will act if Kenyan courts don’t bring to book the perpetrators.

Cord, led by Raila Odinga, has been agitating for the removal from office of the Independent Election Boundaries Commission (IEBC) commissioners citing lack of credibility from the election body.

The ensuing Monday demonstrations have led to the deaths of five protestors. Police have been accused of using excessive force to quell the protestors who have on several occasions attempted to storm the IEBC offices.

Bensouda, in an interview with Nation, said that incase violence ensued in the run-up to the elections or after the polls, ICC will take charge and prosecute the instigators.
She said:

am not praying for bad things to happen, but if ICC crimes are committed, and Kenya does not attempt to try those cases, the court will do its duty and discharge its obligation under the Rome Statute” President Uhuru Kenyatta and his Deputy William Ruto were among the high level suspects who were unsuccessfully tried at the ICC. Bensouda blamed the collapse of the cases to interference of witnesses.

Bensouda said that Kenya was a State Party to the Rome State and if crimes against humanity are committed she will act.
